1. ELIGIBILITY:  To be eligible to win a prize in the Dimesports Fantasy Football game (the “Game”), entrants must be 18 years of age or older as of June 1, 2008 (if the age of majority in your jurisdiction is different than 18, you must be the age of majority within your jurisdiction). Use of the Web Site and your eligibility to win prizes is void where prohibited by law and unauthorized in any jurisdiction that does not give effect to all provisions of the Game Rules and Regulations as well as the Terms and Conditions of Use. By registering to play, Entrants agree to be bound by all of the terms and conditions of these Official Rules and Regulations (the “Official Rules”). By registering to play, Entrants also agree to be bound by all of the terms and conditions of the Game Rules and Game Documentation (the “Game Rules”) applicable to the Game as provided by Dimesports, Inc.  Dimesports, Inc. reserves the right to make non-material changes to these Official Rules at any time during the Game. The Game is not be used in connection with any form of gambling or the promotion of gambling.  Employees, officers, directors, agents, and representatives of Dimesports, Inc. and their parents company, affiliates, and subsidiaries, and each of their respective immediate family  and any person residing in the same household as such and sponsors and affiliates and advertising and promotion agencies of Dimesports, Inc. are not eligible to win any prizes.

2. TIME PERIOD:  Registration for the Game will begin on or about June 1, 2008.  The Game will begin on September 4, 2008 and end on or about December 30, 2008, which end date is subject to changes in the NFL schedule.  The Game and participation in the Game are subject to the Official Rules, and all applicable federal, state, provincial and local laws.  All entries  become the property of Dimesports, Inc. and will not be returned.  As set forth in Section 8 below, Dimesports, Inc. reserves the right to limit the number of entries in the Game at any time for any reason.  Void where prohibited by law.

3. TO ENTER:  To play the Game, Entrants must submit an online entry by visiting the Game Web Site located at http://dimesports.net  and either pay the entry fee of $U.S. $49.99 (subject to change as specified on the site)

No refunds will be allowed after the season begins on September 4, 2008 the start of the NFL season.

4. PRIZES: $100,000 Fantasy Football Challenge
At the conclusion of the Game, DimeSports, Inc. will provide prizes to the winners (“Prize Winners”) as follows:

a. Overall Grand Prize winner with the most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $100,000.
b. Second Place Winner with the second most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $10,000.*
c. Third Place Winner with the third most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $5,000.*
d. Fourth Place Winner with the fourth most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $2,500.*
e. Fifth Place Winner with the fifth most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $1000.*
f. The Sixth Place through Tenth Place Overall Finishers with the most total points in the Game at the conclusion of the Game will receive a check  in his/her name for US $500.*
g. The Eleventh Place through One Hundredth Place Overall Finishers with the most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $100.*

a. First Place Division winners with the most total points within their division in the Game at the conclusion of the Game will receive a check in his/her name for US $2,500.
b. Second Place Division winners with the second most total points within their division in the Game at the conclusion of the Game will receive a check in his/her name for US $1,250
c. Third Place Division winners with the third most total points within their division in the Game at the conclusion of the Game will receive a check in his/her name for US $500.
d. Fourth Place Division winners with the fourth most total points within their division in the Game at the conclusion of the Game will receive a check in his/her name for US $250.
e. Fifth Place Division winners with the fifth most total points within their division in the Game at the conclusion of the Game will receive a check in his/her name for US $125.
f. Sixth Place through Tenth Place Division finishers with the most total points in the Game at the conclusion of the Game will receive a check  in his/her name for US $75.

At the conclusion of each week, DimeSports, Inc. will provide prizes to the weekly winners (“Prize Winners”) as follows:

c.Third Place Division winners with the third most points from the prevoius five days (Thurs. - Mon.) at the conclusion of the  week will receive a check in his/her name for US $75.*

d. Fourth Place Division winners with the fourth most points from the previous five days (Thurs. - Mon.)  at the conclusion of the week will receive a check in his/her name for US $50. *
e. Fifth Place Division winners with the fifth most points from the previous five days (Thurs. - Mon.) at the conclusion of the week will receive a check in his/her name for US $25.*
f. Sixth - Tenth  Place Division winners with the sixth - tenth most points from the prevoius five days (Thurs. - Mon.) at the conclusion of the  week will receive a check in his/her name for US $20.*

 

4b. $10,000 Mid-Season Fantasy Football Challenge

a. Overall Grand Prize winner with the most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $10,000.
b. Second Place Winner with the second most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $2,500.*
c. Third Place Winner with the third most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $1,000.*
d. Fourth Place Winner with the fourth most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $500.*
e. Fifth Place Winner with the fifth most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $100.*
f. The Sixth Place through Tenth Place Overall Finishers with the most total points in the Game at the conclusion of the Game will receive a check  in his/her name for US $50.*
g. The Eleventh Place through One Hundredth Place Overall Finishers with the most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $25.*

c. Third Place Division winners with the third most total points within their division in the Game at the conclusion of the Game will receive a check in his/her name for US $100.
d. Fourth Place Division winners with the fourth most total points within their division in the Game at the conclusion of the Game will receive a check in his/her name for US $75.
e. Fifth Place Division winners with the fifth most total points within their division in the Game at the conclusion of the Game will receive a check in his/her name for US $50.

4c. Prizes: $3,000 Fantasy Football Challenge Free League

a. Overall Grand Prize winner with the most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $3,000.
b. Second Place Winner with the second most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $750*
c. Third Place Winner with the third most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $500.*
d. Fourth Place Winner with the fourth most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $250.*
e. Fifth Place Winner with the fifth most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $100.*
f. The Sixth Place through Tenth Place Overall Finishers with the most total points in the Game at the conclusion of the Game will receive a check  in his/her name for US $50.*
g. The Eleventh Place through One Hundredth Place Overall Finishers with the most total points in the Game at the conclusion of the Game will receive a check in his/her name for US $10.*

a. First Place Division winners with the most total points within their division in the Game at the conclusion of the Game will receive a check in his/her name for US $100.
b. Second Place Division winners with the second most total points within their division in the Game at the conclusion of the Game will receive a check in his/her name for US $75
c. Third Place Division winners with the third most total points within their division in the Game at the conclusion of the Game will receive a check in his/her name for US $50.
d. Fourth Place Division winners with the fourth most total points within their division in the Game at the conclusion of the Game will receive a check in his/her name for US $25.

At the conclusion of each week, DimeSports, Inc. will provide prizes to the weekly winners (“Prize Winners”) as follows:

c. First Place Division winners with the most points from the previous five days (Thurs. - Mon.)  at the conclusion of the week will receive a check in his/her name for US $10. *

 

* Dimesports, Inc. reserves the right to limit the number of divisions in the Game at any time for any reason or cancel contest .

5. PRIZE CONDITIONS:  No transfers, alterations, substitutions or cash redemption of the prizes will be permitted, except as provided herein. Prize Winners will be required to execute an Affidavit of Eligibility, a Liability Release and where lawful, a Publicity Release which must be returned with the Affidavit of Eligibility. Dimesports, Inc. reserves the right to substitute prizes of like value in the event described prizes are unavailable for any reason. Subject to the terms of these Official Rules and Regulations, an eligible participant may receive the following prizes:  one (1) among the Grand Prizes through One Hundredth place prizes (whichever prize has the highest approximate retail value), and one (1) prize and all League prizes for which he/she is eligible.  All federal, state or other tax liabilities will be the sole responsibility of the prizewinners.

6. TIE BREAKING:  In the event ties exist at any prize level, ties will be resolved as follows:

Overall Grand Prize Winner through One Hundredth place prize and League prizes -- 
Tiebreaker 1:  Individual with the most Dimesports, Inc. salary dollars remaining at the conclusion of the Game.
Tiebreaker 2:  Individual with the highest single week point total during the Game.

Tiebreaker 3:  Individual with the second highest week point total during the Game.

 

7. WINNER NOTIFICATION:  All Prize Winners will be notified by email (or via U.S. mail if applicable) at the email or regular mail address supplied to DimeSports, Inc., and will have fifteen(15) days from the date such notification was sent to respond by following the instructions provided in such notification.  All Prize Winners will be required to submit valid identification to Dimesports, Inc. and to execute those releases Dimesports, Inc. deems necessary, without additional compensation, including, but not limited to, an affidavit of eligibility, a liability release and a publicity release (where permissible) as described in Section 5 herein. Failure to comply with these requirements may result in disqualification. Dimesports, Inc. is not responsible for and shall not be liable for a prize that is declined or undeliverable, or for any prize or prize notification that is returned as undeliverable or if the winner fails to timely return the above mentioned documentation. In any of these situations the original winner will be disqualified.

 

Game entrants understand that the Game’s results are final in all respects and all decisions regarding the Game, including, but not limited to, selecting potential prize winners and awarding prizes, will be made by Dimesports, Inc., whose decisions will be final and binding.

 

Prize Winners consent to the use by Dimesports, Inc. and their respective designees of their names and likenesses for advertising, publicity and promotional purposes in any media now known or hereinafter developed, without territorial of time limitations, including for use on the Dimesports, Inc. web site (www.dimesports.net). 
 
8. LIMITATIONS OF LIABILITY:  By registering for the Game, all participants release Dimesports, Inc. and their respective parents company, subsidiaries, directors, governors, stockholders, employees, representatives, sponsors and affiliates (collectively, “Released Parties”) from any against and all costs, expenses, liability, damages, claims or actions of any kind, including those related to injuries or damages to persons or property, arising out of or in connection with participation in the Game, receipt, ownership or use of any prize, the preparation for, participation in, or traveling to any prize-related activity or in connection with any claims based upon violation of publicity rights, defamation or invasion of privacy.  Additionally, participants agree that the Released Parties shall not be responsible for a) lost, late, illegible, misdirected, mutilated, incomplete, or postage due mail; b) any incorrect or inaccurate information, whether caused by web site users or by any of the equipment or programming associated with the Game or by any technical or human error that may occur in the processing of entries in the Game; c) any problems or technical malfunction of any telephones, software, or hardware, failure of e-mail on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Game; d) any error, omission, interruption, deletion, defect, delay in operation or transmission, or the theft, destruction or alteration of entries or other materials; and e) the cancellation or postponement of any games during the Game. Dimesports, Inc. may prohibit any entrant from participating in this Game or any future promotion of  the game and may refuse to award a prize or prizes to an entrant if Dimesports, Inc. determines in its sole discretion that such entrant (i) has tampered with the entry process or the operation of the Game or any web site, (including, without limitation, trying to defraud, reverse engineer, disassemble, decompile or otherwise tamper with the Game’s computer programs and systems), (ii) has violated the Game Rules, or (iii) has acted (a) in an un-sportsmanlike manner, (b) with an intent to annoy, abuse, threaten, or harass Dimesports, Inc. or any entrant, or (c) in an improper manner that is adverse to the operation of the Game or detrimental to another Entrant, or (d) in any other disruptive manner.  The use of any automated entry device is prohibited. All taxes, fees and surcharges on prizes are the sole responsibility of the winners. If, for any reason, the Game is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, player strike or lock-out, or any other cause beyond the control of Dimesports, Inc. which corrupt the administration, security, fairness, integrity or proper conduct of the Game, Dimesports, Inc. reserves the right in its sole discretion to cancel, terminate, modify or suspend the Game and, at their discretion, award prizes from among all non-suspect eligible participants and/or disqualify suspect entrants. In the event of a dispute as to the identity of any online Prize Winner, the Prize Winner will be deemed to be the authorized account holder of the applicable e-mail address at issue. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME IS A VIOLATOIN OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, DIMESPORTS, INC. RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

9. USE OF DATA:  Dimesports, Inc. will collect and use personal data in accordance with its privacy policy available for review at www.dimesports.net.

10. RULES:  To receive a copy of the Game Rules please contact by sending a request to support@dimesports.net.  Requests received after the completion of the Game will not be honored.

 

11. GAME OF SKILL: The Game is one of skill. Winners are determined by the objective criteria described on the the Web Site. From all entries recieved, winners are determined by the individuals who use their skill and knowledge of relevant professional sports information and fantasy sports rules to accumalate the highest point totals during the Game according to the Official Rules and Regulations.

 

12. WINNERS LIST: To obtain a winners list please send a request to support@dimesports.net. Requests received after February 1, 2009 will not be honored.

13. CHOICE OF LAW:  Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of the Game Rules or the rights and obligations of the entrants and Dimesports, Inc., in connection with the Game shall be governed by, and construed in accordance with the laws of the State of Georgia.  All entrants consent to the jurisdiction and venue of the courts located within Atlanta, Fulton County, Georgia.

14. ARBITRATION: All disputes out of, or with respect to the interpretation of the rights of parties arising out or related to the subject of Entrants' participation, or intended participation in the Game shall be governed by the laws of the state of Georgia. The parties agree to submit all such disputes to final and binding arbitration. The arbitrator shall be selected in accordance with the Rules of the American Arbitration Association. The place of any such arbitration shall be Atlanta, Georgia. The arbitrator’s award shall be final, and the judgment may be entered upon it by any court having jurisdiction thereof. This arbitration provision shall remain in full force and effect notwithstanding the nature of any claim or defense hereunder and the prevailing party shall be awarded reasonable attorney fees in connection therewith.

 

All decisions of Dimesports, Inc. regarding the foregoing are binding and final.  All unclaimed prizes and prizes for which it is determined an Entrant is ineligible will be forfeited and Dimesports, Inc. may select a runner-up winner as set forth herein, in its sole discretion.
